Terms and Conditions
 

These Terms and Conditions govern the tourist and holiday accommodation arrangements between Walters’ Holiday Flats (“we, our, us”) and its Guests.


1. TOURIST & HOLIDAY PURPOSES

Guests may occupy the accommodation booked during the stipulated period.  Guests agree that their use of the accommodation is for tourist or holiday purposes only.


2. PAYMENT BY DIRECT DEPOSIT or PAYPAL

Guests may pay the initial deposit and the balance of the booking fee directly to our bank account or via PayPal, the details of which are provided by email.

The booking is deemed to have been secured when the deposit is paid.  Payment of the balance of the booking fee is required at least 2 weeks prior to check-in.


3. CANCELLATION BY GUESTS

Any cancellation must be notified to us by email (bookings@waltersholidayflats.au) and a cancellation will not take effect until we have confirmed acceptance of the cancellation.

Any cancellation will give rise to the following charges (except for bookings for the Xmas, New Year and Easter holiday periods – when no payments are refundable):

- for any cancellation made 2 weeks or more before the date of arrival: we will refund the deposit and any pre-payment received by us from Guests; 

- for any cancellation less than 2 weeks before the date of arrival: we will retain the deposit paid, and

- for any cancellation less than 2 days before the date of arrival: we will retain the deposit and the balance paid.


4. REFUNDS

A full refund is available if there is a government issued warning to not travel to Hyams Beach due to a natural disaster or other circumstances in which Guests are prevented by law from entering Hyams Beach.

No refund is available if Guests vacate prior to their departure date, unless there is a government issued warning to evacuate the Hyams Beach area or other circumstances in which Guests are required by law to leave Hyams Beach.


5. CHECK-IN & CHECK-OUT TIMES

Guests may check-in from 3.00 pm on the day of arrival.

Guests must check-out prior to 10.00 am on the day of departure.


6. GUESTS PER FLAT

Flats 1 - 3 are limited to 4 (four) Guests per Flat.

Flat 4 is limited to 2 (two) Guests per Flat.


7. PRIVATE, DIRECT BEACH ACCESS FOR RECREATIONAL ACTIVITIES

The path for private, direct beach access is for Guests only and is not available to other visitors.   Since the path is next to a private residence, Guests must keep to the path.

Please note that use of the path is entirely at the Guests’ own risk.

Use of the path by Guests is for the sole purpose of engaging in recreational activities.

We will not be liable for any loss or injury the Guests or any person under the Guests’ control, occupying or using the accommodation may incur or any claim that may be made in respect of or which arises as a result of or in connection with using the path to access the beach for recreational activities through 68 Cyrus Street, Hyams Beach.


8. GUESTS’ OBLIGATIONS

Guests shall:

  1. not have any pets in or near the Flats;

  2. not smoke or take any illegal drugs in or on the porch of the Flats;

  3. not engage in inappropriate or offensive behaviour, including due to intoxication, in or near the Flats;

  4. not disturb the surrounding community with a disruptive level of noise after 10.00 pm, in accordance with Shoalhaven City Council regulations;

  5. not invite into the Flats any person whose behaviour is likely to be disruptive to the enjoyment of other Guests;

  6. not have more than the maximum number of Guests per Flat, and

  7. not leave the Flat in a state that requires excessive or deep cleaning (unwashed dishes, damaged bed linen, soiled lounges, chairs or carpets, etc.). The booking fee covers the cost of a standard clean between reservations (laundry, vacuuming, etc.).  If excessive or deep cleaning is required as a result of the Guests’ stay, an additional cleaning fee of up to $150 may be imposed.

Guests:

  1. agree to pay a reasonable charge for replacement of keys that are lost or not returned;

  2. accept full responsibility for and agree to indemnify the owners and managers against all loss and damage to the premises or its contents, as well as to the possessions of Guests, during their occupancy;

  3. will bear all costs arising from such damage and/or failure to comply with these Terms & Conditions;

  4. on departure, undertake to:

  • wash & dry dishes & return to their place;

  • leave the Flat as clean & tidy as possible;

  • place all rubbish in red & yellow bins outside;

  • leave the key in the lock box next to the Flat, and

  • inform the managers if anything needs repairing or replacing.


9. NON-COMPLIANCE

We reserve the right to deny admission, or to require a person to leave the accommodation, without refund or compensation, for failure to comply with these Terms and Conditions.


10. PRIVACY COMMITMENT
